OLD LYME ZONING BOARD OF APPEALS
REGULAR MEETING
TUESDAY, JULY 16, 2013
MEMORIAL TOWN HALL, 52 LYME STREET
OLD LYME, CT - 7:30 P.M.

Present and voting were Susanne Stutts, Chairman, Richard Smith, alternate (seated for Judy McQuade arrived at 7:45 p.m.), Mary Stone, Secretary, Kip Kotzan, regular member, Art Sibley, regular member

Present:  George Hunt, alternate and Kim Barrows, Clerk

Absent:  Judy McQuade, Vice Chairman and Martha Rumskas, alternate

        A Motion was made by K. Kotzan, seconded by M. Stone to amend the agenda to move Case 13-18 – 42 Portland to be the first item so that it could proceed with 4 seated members.  No discussion and a vote was taken.  In favor:  S. Stutts, M. Stone, K. Kotzan, A. Sibley.  The motion passed unanimously.  4-0-0

Case 13-23 – Frederick Guidobono, 42 Portland Avenue

        A Motion was made by A. Sibley, seconded by M. Stone to GRANT the necessary variances to allow the placement of an air conditioning condenser closer to Bocce Lane without conditions.  The reasons for granting are that the project is within the scope of what the Zoning Commission had previously approved and two neighbors spoke in favor of the project.  No discussion and a vote was taken.  In favor:  S. Stutts, M. Stone, K. Kotzan, A. Sibley.  The motion passed unanimously.  4-0-0

Case 13-18 – Luis and Alicia Castanho, 52 Gorton Avenue

        A Motion was made by M. Stone, seconded by A. Sibley to GRANT the necessary variances to allow removal of existing house and construction of a new 1 1/2 story  house (maintaining the existing 15’ 2” street setback) and elevated to comply with new FEMA Flood elevations per the plans submitted and entitled “Plot Plan, Castanho Residence, 52 Gorton Avenue Old Lyme, CT dated April 1, 2013 revised May 14, 2013, revised to June 26, 2013, Sheet L.1 prepared by Deveaux Architects”.  The reasons to grant are that elimination of the side setback, going to two bedrooms, a true 1 ½ story structure and it will conform to the new FEMA regulations;  it is an oversized lot for the area; the design seeks to conform to the look of the neighborhood and the design also seeks to reduce the building bulk facing the street.  No discussion and a vote was taken:  In favor:  S. Stutts, K. Kotzan, M. Stone, A. Sibley, R. Smith   In opposition:  None   Abstaining:  None   The motion passed unanimously. 5-0-0   

Case 13-24 – Joseph Piecuch, Michele Potvin-Piecuch and the Irmgard J. Ziemba
Trust, 26 Massachusetts Road

        A Motion was made by K. Kotzan, seconded by R. Smith to CONTINUE THE PUBLIC HEARING TO THE SEPTEMBER 17, REGULAR MEETING FOR 26 MASSACHUSETTS ROAD in order to see if the applicants can reconfigure the space.  No discussion and a vote was taken:  In favor:  S. Stutts, K. Kotzan, M. Stone, A. Sibley, R. Smith   In opposition:  None   Abstaining:  None   The motion passed unanimously. 5-0-0

Case 13-25 – Paul Preissler, 88 West End Drive

        A Motion was made by K. Kotzan, seconded by R. Smith to DENY the variances requested to construct a 10’ x 21’ deck on the ocean side of 88 West End Drive as per plans submitted. No discussion and a vote was taken:  In favor:  S. Stutts, K. Kotzan, M. Stone, A. Sibley, R. Smith   In opposition:  None   Abstaining:  None   The motion passed unanimously. 5-0-0

Case 13-26 C – Mark and Maryellen Phelan, 77 Sea Spray Road

        A Motion was made by K. Kotzan, seconded by R. Smith to OPEN THE PUBLIC HEARING FOR 77 SEA SPRAY ROAD AND CONTINUE TO THE SEPTEMBER 17, REGULAR MEETING in order to obtain further information and a denied Certificate of Zoning Compliance Permit Application.  No discussion and a vote was taken:  In favor:  S. Stutts, K. Kotzan, M. Stone, A. Sibley, R. Smith   In opposition:  None   Abstaining:  None   The motion passed unanimously. 5-0-0

Adjournment

        A Motion was made by S. Stutts, seconded by K. Kotzan to adjourn the July 16, 2013 Regular Meeting; no discussion and a vote was taken.  The motion to adjourn passed unanimously.  5-0-0    The meeting adjourned at 9:10 p.m.

There is no ZBA Meeting in August
